Terms of Service

1. Acceptance of Terms

By accessing or using Deskly ("the Service"), provided by Deskly GmbH ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service.

2. Description of Service

Deskly is a multi-tenant ticket support and collaboration platform that provides workspace management, ticket tracking, real-time chat, approval workflows, and related features. The Service is accessible via web browsers at deskly.support and its subdomains.

3. Account Registration

To use the Service, you must:

  • Create an account with a valid email address.
  • Provide accurate and complete registration information.
  • Maintain the security of your account credentials.
  • Notify us immediately of any unauthorized account access.

You are responsible for all activities that occur under your account.

4. Workspaces & Multi-Tenancy

Each workspace ("tenant") operates independently. Workspace administrators control user access, roles, and settings within their workspace. Data is logically isolated between workspaces. Users may belong to multiple workspaces with different roles.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of applicable laws.
  • Upload malicious code, viruses, or harmful content.
  • Attempt to gain unauthorized access to other workspaces or system components.
  • Interfere with or disrupt the Service or its infrastructure.
  • Scrape, crawl, or use automated tools to extract data from the Service.
  • Impersonate another person or entity.
  • Use the Service to send unsolicited communications (spam).

6. Content & Data Ownership

You retain ownership of all content you create, upload, or share through the Service ("Your Content"). By using the Service, you grant us a limited license to host, store, and display Your Content solely for the purpose of providing and improving the Service.

Workspace administrators may have access to content within their workspace. We do not access workspace content except as necessary for service operation, security, or legal compliance.

7. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will provide reasonable notice of planned downtime when possible.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Deskly GmbH shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business opportunities arising from your use of the Service.

9. Termination

You may terminate your account at any time by contacting support. We may suspend or terminate your access to the Service if you violate these Terms, with or without notice. Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or legitimate business purposes.

10. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use of the Service after changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Berlin, Germany.
